Welcome to My Sunrise App, a progressive web application operated by My Sunrise App, LLC ("we," "our," or "us"), a company based in Houston, Texas. By accessing or using our app or website, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our service.

2. Important Health Disclaimer

My Sunrise App is not a healthcare application and is not licensed or regulated to provide medical diagnosis, treatment recommendations, or healthcare services.

This app is designed to support your recovery journey but should never replace professional medical care. You should always:

3. Eligibility

You must be at least 14 years old to use My Sunrise App. By using our service, you represent that you are at least 14 years old and have the legal capacity to enter into these Terms.

4. Geographic Restrictions

My Sunrise App is intended for use by residents of the United States only. We reserve the right to restrict access from other geographic locations.

5. Description of Service

My Sunrise App provides tools and features to support individuals in their traumatic brain injury (TBI) recovery journey, including:

Progress tracking and journaling capabilities
Educational content and resources
Reminder systems
Goal setting tools
Personal data collection and analytics
Premium features including AI-powered insights and photo uploads

6. Account Registration and Security

You must provide accurate and complete information when creating an account
You are responsible for maintaining the confidentiality of your login credentials
You agree to notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms

7. Subscription Plans and Billing

7.1 Service Tiers

Free Trial: trial access to basic features
Basic: unlimited access to core features
Premium: includes AI features, photo uploads, and additional analytics

7.2 Payment Processing

All payments are processed through our third-party payment processor, Stripe. By subscribing, you agree to Stripe's terms of service and authorize recurring charges.

7.3 Billing and Renewals

Subscriptions automatically renew unless cancelled
You will be charged at the beginning of each billing period
Price changes will be communicated 30 days in advance

7.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings
Cancellations take effect at the end of your current billing period
No partial refunds are provided — if you cancel mid-cycle, you retain access until your paid period expires
Refunds may only be requested by contacting customer support and are granted at our sole discretion
Refund requests must be submitted within 30 days of the charge

8. User Content and Data

You retain ownership of any content you submit to the app, including journal entries, photos, and personal data. By submitting content, you grant us a limited license to store, process, and display your content solely for the purpose of providing our services to you. We implement appropriate technical and organizational measures to protect your personal health information (PHI) in compliance with HIPAA requirements.

9. Privacy and Data Protection

10. Acceptable Use

You agree not to:

Use the app for any unlawful purpose

Use the app in any way that could interfere with other users' access

11. Intellectual Property

The My Sunrise App, including all content, features, and functionality, is owned by My Sunrise App, LLC and is protected by copyright, trademark, and other intellectual property laws.

13. Limitation of Liability

To the fullest extent permitted by law, My Sunrise App, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, or other intangible losses, resulting from your use of the service.

Our total liability to you shall not exceed the amount you paid for the service in the 12 months preceding the claim.

14. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Indemnification

You agree to indemnify and hold harmless My Sunrise App, LLC from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

16. Termination

We reserve the right to terminate your account and access to the service at any time, with or without cause, and with or without notice.

17. Data Retention and Account Deletion

Upon account deletion, we will delete your personal data within 30 days, except where retention is required by law
Some aggregated, non-personally identifiable data may be retained for analytical purposes
You may request complete data deletion by contacting customer support
HIPAA-covered information will be retained and disposed of in accordance with applicable regulations

18. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Harris County, Texas.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the service constitutes acceptance of the modified Terms.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
